Terms and Conditions

Welcome to Strutpro.co.za ("Website"), operated by StrutPro ("we," "us," or "our"). 

These Terms and Conditions ("Terms") govern your use of our Website, as well as the purchase and supply of our cable management and reticulation products and services. By accessing our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please refrain from using the Website or engaging in transactions with us.

 

1. Prices Quoted

 

1.1 Pricing Basis: All prices quoted are Nett, Ex Works (Epping, Cape Town, South Africa), and denominated in South African Rand (ZAR), unless otherwise agreed in writing.

 

1.2 Exclusions: Prices exclude Value Added Tax (VAT), customs duties, import/export fees, and any other statutory levies or charges. Errors and Omissions Excluded (E&OE).

 

1.3 Validity: Quotations remain valid for 30 calendar days from the date of issue, subject to adjustment due to fluctuations in raw material costs, exchange rates, or unforeseen economic factors beyond our control.

 

1.4 Delivery Period: Delivery timelines will be confirmed and negotiated upon receipt of an official purchase order, dependent on stock availability and production schedules.

 

1.5 Packaging: Quotations include standard StrutPro packaging suitable for cable management and reticulation products. Additional crating, specialized packaging, or export-compliant packing will incur extra charges, as specified.

 

2. Bulk Deliveries

 

2.1 Standard Deliveries: Bulk deliveries within the Cape Metropolitan Area are included in the quoted price, provided there are no site-specific restrictions (e.g., permits, access limitations, or offloading constraints).

 

2.2 Additional Deliveries: Interim, expedited, or special deliveries outside standard bulk delivery terms will incur additional charges, payable by the client.

 

2.3 Client Responsibilities: Clients must ensure safe and accessible delivery locations. Any delays or costs arising from site conditions (e.g., lack of access or offloading equipment) will be for the client’s account.

 

3. Supply Unit / Specification

 

3.1 Product Standards: All cable management and reticulation products will be supplied in standard manufactured lengths and specifications as outlined in StrutPro’s latest catalogue, available upon request. Deviations (e.g., custom cuts or configurations) will be explicitly noted in the quotation.

 

3.2 Finishes: Prices for epoxy powder-coated items apply to StrutPro’s standard color range. Non-standard colors or finishes (e.g., galvanizing, stainless steel) will incur additional costs and may extend delivery timelines.

 

3.3 Quality Assurance: Products comply with applicable industry standards for cable management and reticulation systems. We reserve the right to substitute materials or components of equivalent or superior quality if specified items are unavailable, with prior notice where feasible.

 

4. Delivery Terms

 

4.1 Cost Estimates: Delivery costs in quotations are estimates based on quoted quantities, current fuel prices, and standard routing. Adjustments may apply due to fuel price fluctuations, route changes, or additional client requirements.

 

4.2 Delivery Timelines: Same-day delivery is not guaranteed. Orders placed after 12:00 PM (SAST) may be scheduled for the next available delivery slot, subject to operational capacity.

4.3 Order Manufacturing Time: Products not available from current stock or those requiring special project orders have a manufacturing time of 4–6 weeks from the date of receiving an official written purchase order. This timeline is subject to the availability of raw materials from our stock or local suppliers at the time the order is placed.

 

4.4 Payment Condition: Goods will not be dispatched or released for collection until full payment has cleared in StrutPro’s bank account, unless prior credit terms have been agreed in writing.

 

4.5 Risk and Responsibility: Risk of loss or damage transfers to the client upon dispatch from StrutPro’s premises (Ex Works) or upon handover to the client’s nominated carrier.

 

5. Payment Terms

 

5.1 Cash Clients:

  • Payment is required in full via Electronic Funds Transfer (EFT) or card payment prior to dispatch or collection.

  • Funds must reflect as cleared in StrutPro’s account before goods are released.

 

5.2 Account Clients:

  • A 2.5% settlement discount applies to payments received within 30 days from the date of StrutPro’s monthly statement.

  • Overdue amounts exceeding 60 days will incur interest at the prime lending rate (as set by the South African Reserve Bank) plus 3% per annum, calculated daily and compounded monthly.

  • We reserve the right to suspend further deliveries or services if accounts remain unpaid beyond agreed terms.

 

5.3 Order Integrity: Quoted prices are contingent upon the client placing the entire order as specified. Selective ordering of items may result in price adjustments at our discretion.

 

5.4 Retention of Ownership: Ownership of all goods remains vested with StrutPro until payment is received in full. In the event of non-payment, we may reclaim goods, and the client shall grant reasonable access for such reclamation.

6. Goods Return Policy

6.1 Objective: StrutPro Cape strives to deliver ordered products correctly and defect-free on the first attempt. However, goods may need to be returned for various reasons. This policy ensures all returns are thoroughly investigated to identify the root cause and implement corrective actions to prevent recurrence. It also aims to prevent damage to products destined for return, whether mechanically or through exposure to the elements.

6.2 Customer Responsibilities:

  • It is the customer’s responsibility to thoroughly check and inspect products upon collection or delivery to ensure the correct products, quantities, and quality are received.

  • If a product is defective or incorrect upon collection or delivery, this must be communicated to the respective sales representative. Authorization to return goods must be granted by the sales representative after consultation with quality control, where applicable.
     

6.3 Defective Products Post-Delivery:

  • Any defects discovered after delivery must be reported to the relevant sales representative for investigation and resolution. Only defective material reported within three working days after delivery will be considered, unless approved by StrutPro Cape management.
     

6.4 Return Process:

  • All relevant documentation must be completed to request the return of a product to validate the query.

  • If the correct product was supplied but returned for reasons other than being defective, a handling charge of 15% and/or a transport fee will apply.

  • Products that sustained damage while in the customer’s possession or during transit will be credited at scrap or B-grade value. It is the customer’s responsibility to properly secure and cover goods while in their possession and during return transport.
     

6.5 Warranty: Products are warranted against manufacturing defects for 12 months from the date of delivery, provided they are installed and used as intended. This warranty excludes damage due to misuse, negligence, improper storage, or unauthorized modifications.

6.6 Non-Returnable Items: Custom or specially manufactured items are non-returnable unless defective and approved for return by StrutPro Cape.

7. General Provisions

 

7.1 Force Majeure: StrutPro shall not be liable for delays or non-performance due to events beyond its reasonable control, including but not limited to strikes, load shedding, natural disasters, or supply chain disruptions. Affected parties will be notified promptly, and delivery timelines adjusted accordingly.

7.2 Dispute Resolution: Any disputes arising from these Terms shall first be addressed through mediation in Cape Town. If unresolved within 30 days, disputes will be subject to the exclusive jurisdiction of the South African courts.

7.3 Amendments: We reserve the right to update these Terms with reasonable notice to clients. The latest version, as published on our Website or provided in writing, shall apply to all subsequent transactions.

7.4 Severability: If any clause is found to be invalid or unenforceable, the remaining clauses shall remain in full force and effect.

7.5 Entire Agreement: These Terms, together with the quotation and any written agreements, constitute the entire agreement between StrutPro and the client, superseding all prior negotiations or understandings.

8. Use of the Website

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Website.

Unauthorized use, including hacking or data mining, is strictly prohibited.

9. Intellectual Property

All content on this Website, including text, images, logos, and designs, is the property of StrutPro or its licensors and is protected by copyright and trademark laws.

You may not reproduce, distribute, or use any content without our prior written consent.

10. Privacy

Your use of this Website and our services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

12. Disclaimer

12.1 Right to Amend Terms: The management of Strut Pro Cape (PTY) LTD reserves the right to amend or update these Terms and Conditions as deemed necessary by the company. Any changes will be published on our Website or communicated in writing, with reasonable notice to clients. 

12.2 Primacy of Written Terms: These Terms and Conditions represent the company’s standard terms at all times and supersede any verbal offers or agreements made by our representatives, unless such variations are reduced to writing and signed by both Strut Pro Cape and the client.
